TRAIL EVENT
WAIVER, RELEASE OF LIABILITY AND INDEMNIFICATION

I understand and acknowledge that participating in the trail event occurring on _______________________________________
which may include a mountain bike ride, race, festival or workshop, and or a trail construction or maintenance workday (the “Event”) carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, equipment, vehicular traffic, actions of other people including, but not limited to, other participants, volunteers, and/or organizers or sponsors of the Event. These risks are not only inherent to the activity I will perform but are also present from other volunteers and participants in the Event. I hereby assume all of the risks, both known and unknown to me, of participating in this Event. I realize that these risks may arise from negligence or carelessness on the part of the persons or entities being released from dangerous or defective equipment or property owned, maintained or controlled by them.
I certify that I am sufficiently physically fit for participation in the Event and have not been advised otherwise by a qualified medical person. I acknowledge that this Trail Event Waiver, Release of Liability, and Indemnification form will be used by and relied upon by the Pensacola Off-Road Cyclists, the organizers and sponsors of the Event and the owners, lessees or managers of the land where the Event takes place and that it will govern my rights, actions and responsibilities as to all of them.
In consideration of permitting me to participate in this Event, on behalf of myself, my executors, administrators,heirs, family, next of kin, successors, and assigns, I hereby waive, release and forever discharge the Event sponsors, the Event organizers, the PENSACOLA OFF-ROAD CYCLISTS, UNIVERSITY OF WEST FLORIDA and any landowner, land manager or lessee where the Event may take place, including all of their directors, officers, employees, volunteers, representatives, and agents, and other Event participants and volunteers (“Released Parties”) from any and all liability for my death, disability, personal injury, property damage, property theft, claims, losses, or other damages which I may incur, or actions of any kind which may hereafter accrue to me, in connection with my participation in the Event including my traveling to and from the Event and Event related activities occurring before and after the Event whether such injuries, claims, losses or damages are due to the negligence or carelessness of any of the Released Parties or because of their possible liability with or without fault, and I hereby agree to defend, indemnify and hold harmless each and all of the Released Parties from any and all liabilities, claims made or damages as a result of my participation in the Event, whether caused by the negligence of one or more of the Released Parties or otherwise.
I hereby consent to receive emergency first aid and medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during this Event. I understand that at this Event or related activities, I may be photographed. I agree to allow my photo, video or film, likeness, to be used for any legitimate purpose by the Event sponsors or organizers and their assigns. This Trail Event Waiver, Release of Liability and Indemnification shall be construed broadly to provide a release, waiver and indemnification to the maximum extent permissible under applicable law.
I HEREBY CERTIFY THAT I HAVE READ THIS DOCUMENT IN ITS ENTIRETY AND I UNDERSTAND ITS CONTENT AND THAT I AM SURRENDERING CERTAIN OF MY LEGAL RIGHTS AND OBLIGATIONS OF THE RELEASED PARTIES TO ME, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES, AND THAT I AM ALSO AGREEING TO DEFEND AND INDEMNIFY THE RELEASED PARTIES.

If Participant is less than 18 years of age, their parent or guardian must also agree to and agree and complete this form – no exceptions.
PARENT OR GUARDIAN WAIVER FOR MINORS (Under 18 years old)
The undersigned parent and/or natural guardian does hereby represent that he/she is, in fact, acting in such capacity for the above minor participant (“Minor”) and agrees to save and hold harmless and indemnify each and all of the Released Parties from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the Minor and the parents or legal guardian. Further, as consideration for permitting the Minor to participate in the Event, I agree to not directly or indirectly pursue any claim of negligence or any other liability whatsoever against Released Parties due to the Minor’s participation in the Event and I agree to defend, indemnify and hold the Released Parties harmless from any liability, claim, loss, cost or damage associated with such a claim brought directly by the Minor, his or her executors, administrators, heirs, family, next of kin, successors, and assigns.

I HEREBY CERTIFY THAT I HAVE READ THIS DOCUMENT IN ITS ENTIRETY AND I UNDERSTAND ITS CONTENT AND THAT I AM SURRENDERING CERTAIN LEGAL RIGHTS ON BEHALF OF MYSELF AND THE MINOR, AND OBLIGATIONS OF THE RELEASED PARTIES TO ME AND THE MINOR, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES ON BEHALF OF MYSELF AND THE MINOR, AND THAT I AM ALSO AGREEING TO DEFEND AND INDEMNIFY THE RELEASED PARTIES.
